We understand that there has been some initial confusion regarding what companies are required to submit the 300A summary electronically to OSHA. Companies with 250 or more employees that currently are required to maintain OSHA recordkeeping must submit electronically. Also, industries with 20 – 249 employees in certain NAICS classifications must also submit. Here is the List. If you are required to submit electronically, you have until July 1, 2018 to submit your 2017 300A Summary. In 2019 and every year after that, the electronic submissions are required by March 2.
However, only a small percentage of companies are required to electronically submit their Form 300A data to OSHA. According the final rule, establishments that meet any of the following criteria do NOT have to send their information. Remember, these criteria apply at the establishment level, not to the firm as a whole.
- The establishment’s peak employment during the previous calendar year was 19 or fewer, regardless of the establishment’s industry.
- The establishment’s industry is on thislist, regardless of the size of the establishment.
- The establishment had a peak employment between 20 and 249 employees during the previous calendar year AND the establishment’s industry is noton this list.
Establishments under the jurisdiction of these State Plan states do not currently have to electronically submit their Form 300A summary data: CA, MD, MN, SC, UT, WA and WY. We’re happy to answer your questions.
